  • “Preserving Public Trust: Addressing Judicial Misconduct and Upholding the Rule of Law”

    Judicial Misconduct More than any other branch of government, the judiciary is built on a foundation of public faith, they make rulings on the law. Rulings that the people must believe came from competent, lawful and independent judicial officers. Judicial misconduct comes in many forms and ethical standards address problematic actions, omissions and relationships that deplete public confidence. Common complaints of ethical misconduct include improper demeanor; failure to properly disqualify when the judge has a conflict of interest; engaging in ex parte communication and failure to execute their judicial duties in a timely fashion. Behavior outside of the courtroom can also be at issue. Judicial conduct oversight should not attempt to regulate purely personal aspects of a judge’s life. However, a judge can commit misconduct by engaging in personal behavior that calls their judicial integrity into question. This is true even if the same behavior would merely be considered unwise for the average citizen. As the saying goes, the robe magnifies the conduct. Obvious examples are violations of criminal law, sexual misconduct with staff/attorneys/parties, joining discriminatory organizations and using the judicial position to enhance a private interest.     Case Scenario Twilio SendGrid continues to focus on developing a high number of new products and innovations, making it an increasingly product-centric company. However, some recent failures in new markets for their products have negatively impacted customers, leading to a loss in brand equity. The mediocre customer service levels have led to a deterioration in customer experience overall, making it difficult to maintain a competitive marketplace edge. Twilio SendGrid’s call center workforce is young and dynamic, typically consisting of educated (professionally qualified) knowledge worker millennials with high technology skills. In the past, to manage this workforce’s expectations, the company made incremental changes to the performance management process in line with the latest industry trends. But business demands on these employees have changed rapidly, as they must learn the nuances of new products and processes in compressed timelines with no room for error. Most supervisors viewed the performance process as a necessary evil, although some took the process seriously. Limited funding has prevented any serious discussions about implementing a compensation plan, and for quite some time, employees have complained about flaws in the performance evaluation and compensation process. While Twilio SendGrid leadership has resisted adopting a specific compensation strategy for a variety of reasons, they are now utilizing their SWOT analysis to align strategic efforts operationally and financially to improve the workforce environment. Preparation As the consultant expert for Twilio SendGrid’s new performance management system, you have been tasked with identifying specific issues within the call center that continue to negatively impact employee performance levels. From various managers and employees, you have heard that most expect the system to fail just as past programs have done. The root of the problem was that employees considered the programs often unfair and biased.     Your case study research paper (HW2) is where you will use the information developed in HW 1 and incorporate your research analysis, to create a coherent research paper that is 13-15 pages in length. This number DOES NOT include the Title Page, Abstract, or References Pages.
    Your research paper should include a title page, abstract, body, and reference page. Your paper should have 1-inch borders on all four sides, use times new roman-12 point font, and be double spaced. Since this is an INTL course you need to use the Chicago Style parenthetical citation style with a references page (aka author-date method).

    Your research paper should include the following sections:
    Introduction: This section should be written last and should pull from some of the elements of HW1. You will need to clearly provide an overview of the topic you are writing about, a concise synopsis of the issues, state your research question (or hypothesis), and discuss why the topic is important to investigate. Writing the introduction last is helpful in ensuring that you have incorporated any changes that may have taken place over the course of your research. This section should be approximately 1-2 pages in length.
    Literature Review: All research projects include a literature review to set out for the reader what knowledge exists on the subject under study and helps the researcher develop the research strategy to use in the study. A good literature review is a thoughtful synthesis of important information that pertains to the current study. Literature reviews include a summary and critical assessment of the arguments that exist (including whether or not you agree with them) and are arranged thematically. At the end of your literature review, you should discuss some of the clear gaps in knowledge and explain how your research will help fill this void and further our knowledge of the subject under investigation. The literature review section should be approximately 5-6 pages in length.
    Methodology: This section will pull from, and expand upon, the theoretical framework and research design sections of your research proposal. The Methodology section provides the reader with a clear understanding of how the research was carried out. Explain how you chose the case to investigate, your theoretical framework, your qualitative or quantitative approach, your data collection method, your data analysis (i.e. the questions you asked to help guide your research and thus answer your primary research question), and any potential data limitations and biases that pertain to this specific project. This section should be approximately 2-3 pages in length. Analysis and Findings: Your analysis and findings section should be organized around your theoretical framework. This section should present your analytical arguments based on your findings, and the findings to your research question or hypotheses. This section should be approximately 2-4 pages in length.
    Conclusion: Like any conclusion, it should provide a synopsis of the project, the strategy, the results, and what the research adds to our body of knowledge. Also offer suggestions for avenues of future veins of research for other scholars. This section should be 1-2 pages in length. References: This section will contain all references that you have cited within your paper. They should be listed in Turabian References format and arranged alphabetically. Entitle this section as “References”. Each source notation should be single spaced with one space between each source. Your references should fall within the 18-25 sources range and be made up primarily of peer reviewed content.
